Terms & Conditions

These terms govern the purchase and delivery of property-viewing and buyer-support services from Canary Islands Investments. Please read them before booking.

1. Who you are contracting with

Services are provided by Szilvia Mónika Bodnár, trading as Canary Islands Investments, NIF/NIE Y6028809V, Calle Churruca 24, 35010 Las Palmas de Gran Canaria, Spain. Contact: info@canaryislandsinvestments.com, +34 659 445 821.

“Client” means the person who books a service. These terms apply to every booking, together with our Cancellation Policy, Service Disclaimer and Privacy Policy.

2. What we do

We attend properties on behalf of buyers and provide independent buyer-support and property-viewing services in accordance with the package purchased. We act for and support the buyer. We are not the selling estate agency and we do not represent the seller.

Depending on the package purchased, a service may include:

  • Remote Viewing
  • Live Viewing
  • Detailed Investor Viewing
  • Viewing Day
  • Property observations recorded during the visit
  • Photographs and recorded walkthrough videos
  • Live video viewing where purchased
  • Asking questions to estate agents and sellers, including buyer-specific questions
  • Property comparisons where applicable
  • Rental-market research, indicative rental ranges and indicative gross rental-yield calculations where included
  • Investment-focused observations and written client reports

3. What we do not do

Our service is not a structural survey, valuation, legal due diligence, tax consultation, mortgage consultation or regulated investment or financial advice. In particular, we do not provide:

  • Legal advice
  • Tax advice
  • Regulated financial or investment advice
  • Mortgage advice
  • Property valuation
  • Structural survey
  • Engineering inspection
  • Architectural inspection
  • Technical building certification
  • Legal due diligence
  • Guaranteed rental income
  • Guaranteed investment returns
  • Any guarantee of short-term-rental (VV / holiday-rental) eligibility

4. Nature of our observations

Our observations are based on what is reasonably visible and available at the property during the viewing, and on information given to us at that time.

We do not dismantle fixtures, lift floors, open walls or installations, move heavy furniture, conduct invasive or destructive testing, use specialist diagnostic equipment, or certify the condition, safety, legality or value of the property.

We cannot identify hidden or latent defects. A viewing is not a substitute for instructing an independent surveyor, architect, engineer or lawyer.

5. Estate-agent and third-party information

Information supplied by an estate agent, seller, community administrator or any other third party — including measurements, prices, licences, community fees, permitted use, rental history and legal status — is third-party information. It is identified as such in our reports and is not independently verified by us unless we expressly state otherwise. Third-party information should be verified by your lawyer or the appropriate professional before you commit to a purchase.

6. Photographs and video

Where included in the package, photographs and video are intended to help the client understand the property remotely. They are illustrative and do not show every part of the property or every defect.

The ability to photograph or film is subject to permission and access granted at the property by the agent, seller or occupier. If permission is refused or restricted, we will record this and deliver the rest of the service. Media is stored privately and shared with the client through secure links.

Media produced by us remains our intellectual property and is licensed to the client for their personal use in evaluating the property; it may not be republished commercially without our written permission.

7. Live video viewings

Where a live video viewing is included, it depends on the mobile network or Wi-Fi coverage at the property and on the agent or seller allowing a live connection. Where a live connection is not possible, we will record a walkthrough video instead and inform the client.

8. Investment information

Rental estimates, comparable properties, price-per-square-metre information and indicative gross yields are research and estimates based on market information available to us at the time. They are not valuations, guarantees or regulated investment advice.

Actual rent, occupancy, costs and investment performance can and do differ. Figures are presented as indicative earning potential, estimated rental range and indicative gross rental yield, and must not be treated as guaranteed earnings.

Floor areas are reported as supplied to us or as indicated in listings, and any price-per-square-metre figure derives from those areas. Areas are not measured by us and must be verified independently.

9. Short-term rentals

We never guarantee eligibility for short-term or holiday rental (including VV / vivienda vacacional registration). Any discussion of short-term rental potential is general information only.

Eligibility, licensing, community-of-owners restrictions, planning and permitted-use rules, tourist-zone regulations and applicable legislation change over time and require independent verification by a qualified Spanish lawyer or the competent authority before you purchase.

10. Property access

The service depends on access being provided by the estate agent, seller or authorised representative. We cannot guarantee that an agent or seller will provide access, allow photography or answer every question.

Where access is refused or an appointment is cancelled by the agent or seller, the Cancellation Policy applies and the booking will be rescheduled or refunded as set out there. We will always tell the client which questions could not be answered.

11. Booking and payment

A booking is only confirmed when all of the following have occurred:

  • The required booking information has been supplied by the client, including the property or listing details and any specific questions.
  • We have reviewed and accepted or confirmed the booking. Submitting a form is a request only and does not create a confirmed appointment.
  • Full payment for the package has been received.

12. Prices and payment method

Prices are shown per package on our Packages page in euros. Any applicable Canary Islands indirect tax (IGIC) will be shown before payment where it applies.

Payment is made by secure online card payment or bank transfer, as indicated at the time of booking. Card details are handled by the payment provider and are never stored by us. We do not treat a booking as paid until payment has been confirmed by the payment provider or received in our bank account.

13. Delivery of the service and reports

We deliver the written client report within the timescale stated for the package purchased, normally within a few working days of the viewing, and we tell the client if more time is needed, for example when awaiting an answer from an agent.

Reports are shared through a private link. The client may share the report with their own advisers, lawyer or family. Reports may not be published, resold or supplied to an estate agency for marketing use.

14. Client obligations

The client agrees to:

  • Provide accurate property details, listing links and contact information.
  • Provide their questions and priorities before the viewing where possible.
  • Be available for a live viewing or call where the package requires their participation.
  • Not ask us to perform any task requiring a professional qualification we do not hold, or any act that would be unlawful.

15. Liability

We deliver our services with reasonable care and skill. To the extent permitted by law, our total liability in relation to a booking is limited to the amount paid for the affected service.

We are not liable for the accuracy of third-party information, for the decisions of agents or sellers, for the outcome of a purchase, for rental or investment performance, or for losses arising because the client relied on our observations instead of instructing an appropriate professional.

Nothing in these terms excludes or limits liability for fraud, for death or personal injury caused by negligence, or any liability that cannot be excluded under applicable consumer law.

16. Cancellation and withdrawal

Cancellation, rescheduling, refunds and the statutory 14-day right of withdrawal are set out in our Cancellation Policy, which forms part of these terms.

17. Complaints and dispute resolution

If you are not satisfied, contact us at info@canaryislandsinvestments.com and we will respond as quickly as possible. Consumers resident in Spain may also request the official complaints form (hoja de reclamaciones) and consumers in the EU may use the European Commission's online dispute-resolution platform.

18. Governing law

These terms are governed by Spanish law, with the courts of Las Palmas de Gran Canaria having jurisdiction, without prejudice to mandatory consumer-protection rules that allow a consumer to rely on the law and courts of their country of residence.

19. Changes to these terms

We may update these terms. The version applicable to a booking is the version published when the booking was accepted; that version and the date and time of acceptance are recorded with the booking.
